The Steps The Landlord Should Take Are:
1) Notice to Vacate
2) File Eviction Suit
3) Tenant Served with Eviction Papers
4) Writ of Possession
If the tenant has not vacated after the court’s judgment, the landlord may request a Writ of Possession. This court order authorizes the constable to remove the tenant and oversee the return of possession of the rental property to the landlord.
5) 24-Hour Notice & Property Set-Out
This is where the eviction process can get confusing.
After a Writ of Possession is issued, the Texas State Law Library explains:
"The constable must post a 24-hour notice before removing the tenant's property from the rental."
This 24-hour period occurs before the Writ of Possession is executed. Once the constable returns to execute the writ, the tenant may be removed and possession of the rental returned to the landlord. The tenant's belongings may also be removed from the rental as permitted during the process.
This is where Zebra steps in.
